Buy a watch

INTRODUCTION

This section (together with the documents expressly referred to in it) tells you information about us and the terms and conditions on which we sell any of the products listed on our website to you.

These terms and conditions will apply to any contract between us for the sale of our products to you. Please read these terms and conditions carefully and make sure that you understand them, before ordering any products from our website. Please note that by ordering any of our products, you agree to be bound by these terms and conditions and the other documents expressly referred to in it.

If you refuse to accept these terms and conditions, you will not be able to order any products from our website.

These terms and conditions should be read in conjunction with our "Warranty", "Privacy Policy" and "Terms of Website Use" terms and conditions.

Please note that these terms and conditions only apply to our consumer customers. If you are a business, you will be advised of the terms and conditions applicable.

  1. INTERPRETATION
    1. The following definitions and rules of interpretation apply in these terms and conditions:

      Our website, the website: the website at the domain http://www.watchfinder.co.uk

      Watch(es), product(s), good(s), item(s): the watch (or any part of it) that you wish to buy together with any accompanying box, sales literature, promotional material and other documentation (where applicable), or any other product that we advertise for sale (including without limitation watch winders).

      We, us, our: Watchfinder.co.uk Limited (registered in England and Wales with company number 04524723).

      You, your: the person or other entity that wishes to purchase a product from us.

    2. Clause headings shall not affect the interpretation of these terms and conditions.
    3. Unless the context otherwise requires, words in the singular shall include the plural and in the plural shall include the singular.

  2. OUR CONTRACT WITH YOU
    1. Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each page of the order process.
    2. When you submit an order to purchase a product from us, your order represents an offer to us to purchase a product.
    3. After you place an order, you will receive an e-mail from us acknowledging that we have received your order. However, please note that this does not mean that your order has been accepted. Our acceptance of your order will take place as described in paragraph (d) below.
    4. We will confirm our acceptance to you by sending you an e-mail that confirms that the products have been dispatched (Dispatch Confirmation). The contract between us will only be formed when we send you the Dispatch Confirmation. Any products forming part of the same order which we have not confirmed in the Dispatch Confirmation do not form part of that contract.
    5. All products shown on our website are subject to availability. If we are unable to supply you with the products, for example because that product is not in stock or no longer available or because of an error in the price on our website as referred to in clause 3(e), we will inform you of this by e-mail and we will not process your order. If you have already paid for the products, we will refund you the full amount as soon as possible.
    6. Without prejudice to clause 2(e) above, please note that all watches will remain on our website and will be available for sale to another customer until you have paid a deposit to us (regardless of any finance application that is made by you).
    7. The images of the products on our website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your computer's display of the colours accurately reflect the colour of the products. Your products may vary slightly from those images.
    8. In the case of products sold without accompanying paperwork, the age listed on the website is an estimate only. While this estimate has been given in good faith, no representation or warranty, express or implied, is made by us in relation to the accuracy of this information. Please note that in the case of watches sold with paperwork, the age of the watch is the date that the warranty is officially stamped by the retailer: this is not the date of manufacture, which may be significantly earlier.
    9. Please note that "water resistant" watches are not necessarily “water proof.” For example, a watch advertised as water resistant to 30 metres (100 feet/3 ATM) cannot be worn swimming, but can only withstand splashes or brief immersion in water. For a full guide, please see our online glossary (under “W” for “Water Resistance”). All watches sold by us are subject to our categorisation, as detailed in the glossary. We do not accept and are not bound by any conflicting advice from third parties including manufacturers. All watches are water tested to manufacturer specifications prior to sale to ensure that the advertised water resistance is accurate: we will not replace seals/gaskets or other parts if the watch passes our testing procedures, regardless of any manufacturer guidance to the contrary.
    10. Our watches are usually supplied with standard bracelet sizes of 18.5 cm for men or 16 cm for women unless you are advised to the contrary.

  3. PRICE AND PAYMENT
    1. The price of the products will be set out in our online system that is specific for your order. Our prices may change at any time, but price changes will not affect orders that we have confirmed with you.
    2. The prices quoted on our website are in Pounds Sterling. You will be responsible for the exchange rate and you are advised that refunds may be affected by such exchange rate. Payments must be made in pounds sterling and any refunds will only be issued in Pounds Sterling.
    3. The price quoted includes VAT (or similar sales tax) at the prevailing rate. However, if the rate of VAT changes between the date of the order and the date of delivery or performance, we will adjust the rate of VAT that you pay, unless you have already paid for the products in full before the change in the rate of VAT takes effect.
    4. The prices for the products exclude delivery costs, which will be added to the total amount due.
    5. Our website contains a large number of products. It is always possible that, despite our best efforts, some of the products we sell may be incorrectly priced. We will normally check prices as part of our dispatch procedures so that:
      1. where the product’s correct price is less than the price stated on our website, we will charge the lower amount when dispatching the products to you. However, if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mispricing, we do not have to provide the products to you at the incorrect (lower) price; and
      2. if the products’ correct price is higher than the price stated on our website, we will contact you as soon as possible to inform you of this error and we will give you the option of continuing to purchase the product at the correct price or cancelling your order. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled and notify you in writing (which include e-mail).
    6. Where we are providing products to you, you must make payment for products in advance. In all cases we must receive full and cleared funds prior to dispatch of the products to you. We accept payment by the following methods if you are based in the UK:
      • Debit card: No surcharge. The watch must usually be dispatched to the billing address of the card holder. Payments must be "3D secure." Please also see our full delivery policy;
      • Credit card: 2% surcharge applies to most credit card payments. A 3% surcharge applies to American Express card payments. The watch must usually be dispatched to the billing address of the card holder. Payments must be "3D secure." Please also see our full delivery policy;
      • Cash: We can accept cash payment up to and not exceeding £9000.00. All notes will be authenticated on the premises. You may also be asked to provide evidence of identity and proof of address;
      • Cheque: Payable to "Watchfinder.co.uk Limited". Funds may take up to 9 working days to clear into our account;
      • Bankers draft: Payable to "Watchfinder.co.uk Limited." All drafts will be authenticated by our bank before the watch is released;
      • Bank transfer: We accept payment by CHAPS, BACS, international and faster payment (same day) transfers. Please contact us for our bank account details;
      • Part exchange: We can accept your current watch as part payment towards another watch that you wish to purchase from us. You will be advised of the part exchange allowance we attribute to your watch. Where your part exchange allowance exceeds the purchase price of the watch, we will issue you with the appropriate credit by bank transfer. Where your part exchange allowance is less than the purchase price of the watch, you can pay the outstanding balance using another method listed above; and
      • Finance options: You can spread the cost of your watch over a period of 6 or 36 months with one of our finance options.
    7. If you are based outside the UK, you will need to pay by an international bank transfer. Please also see our delivery policy for information relating to delivery times, charges and customs. If you would like any further information, please call or email a member of our sales team prior to placing your order.
    8. If after paying the initial deposit for the products we do not receive the balance payment in full and cleared funds within a reasonable time, namely 3 weeks after we receive the deposit payment from you, then we reserve the right to cancel the transaction and relist the watch for sale on our website.

  4. DELIVERY
    1. Delivery destinations and charges

      Timescales for delivery will vary depending on factors including availability of the products and your address. Unfortunately, we may not be able to deliver to the following countries:

      Afghanistan; Angola; Cuba; Ethiopa; Iran; Iraq; Lebanon; Liberia; Libya; Myanmar; Nicaragua; Nigeria; North Korea; Rwanda; Sierra Leone; Somalia; Sudan; Syria; Uganda; Zimbabwe; and countries comprised by the former territories of USSR and/or the Federal Republic of Yugoslavia and/or the Republic of Serbia.

      If, however, you would like the products to be delivered to any of the countries listed above, please get in touch with a member of our sales team to discuss your options.

      Delivery charges will vary depending on your address and the weight of the parcel. Deliveries to any location within the UK will usually cost £12.00. If you are based outside of the UK, we will advise you of our delivery charges.

      If returning an item to us, you will be responsible for the postage and packaging costs unless we waive this requirement in writing (which includes email and fax).

      Please note that customers outside of the EU will not be refunded their postage costs for unsuitable items.

    2. Delivery method and date

      Domestic deliveries are usually made using the Royal Mail's Special Delivery™ service. Royal Mail guarantee that your item will arrive before 1.00 pm on the next working day following dispatch of the item by us to addresses within the UK.

      Notwithstanding the above, all dates quoted by us for dispatch and delivery of your products are estimations only. Watchfinder will not be liable for any delay in delivery of the products that is caused by an event outside of our control or your failure to provide us with adequate delivery instructions or any other instructions that are relevant to the delivery of the products. Time of delivery is not of the essence.

      A signature will be required for receipt of our products by an adult (aged 18 years or over) at the delivery address (whether yourself or a member of your household).

      If you or a member of your household is not available when the carrier attempts delivery, they may leave a calling card for you to re-arrange delivery at a more convenient time. Alternatively, you may collect the products from your local delivery office provided you can produce adequate proof of identity.

      Any parcel which has been damaged or tampered with should not be signed for and delivery should be refused.

    3. Delivery address

      We will deliver the products to the delivery address given by you at the point of purchase. Please note that, for security reasons, if you pay by debit or credit card, we will usually only deliver to your billing address.

      If you purchase products from us using one of our finance options, we will only deliver to your address as detailed in the finance agreement (as an anti-fraud measure). In all other cases, we will comply so far as is reasonably practicable with any lawful instructions by you concerning the products given or confirmed in writing (which shall include email or fax) prior to dispatch of the products, provided that further charges may be incurred by you depending on your instructions (such as additional postage costs).

    4. Collection

      Products may be collected by appointment only from our offices in Maidstone and London. Please note that, for security and other reasons, if you wish to collect your watch in this way, it is essential that you contact us in advance to make an appointment. A weekend appointment must be confirmed by the close of business on the previous working day. We do not want you to have a wasted journey, so please make an appointment.

    5. Completion of delivery

      Delivery of the products will be completed when we deliver the products to the address you gave us or you collect them from us. Please note that if you arrange for your own courier to collect the products, delivery will be completed when the watch is collected from our offices.

    6. Risk and title

      Risk in the products will pass to you on completion of delivery, though ownership of the products will only pass to you when we receive payment (in full and cleared funds) of all sums due in respect of the products, including all delivery charges.

  5. CUSTOMS
  6. If you are based outside of the UK, you may also have to pay import duty or other taxes, fees and charges applied by customs or other authorities in the country of receipt. You must comply with all laws and regulations of the country in which you are receiving the products. Any additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. If you are unsure about whether these charges might apply to your order, you should contact your local tax or customs office for further information.

  7. RETURNS AND CANCELLATIONS
    1. Cooling off period

      You have 7 working days (from the day after delivery of your watch to you) to cancel the contract for your order with us.

      You will be refunded in full provided that the watch is returned in its original condition and with all associated items, including without limitation its box and any paperwork. It will be inspected on arrival and, if it is found to have been damaged, there will be an additional charge for any refurbishment or other works that are necessary to return the watch to its original condition. Customers are liable for any return postage costs and must ensure that the item is fully insured. We recommend that you obtain proof of posting.

      In particular, you will be responsible for any and all depreciation costs incurred as a result of any loss of or damage to the paperwork and other documentation and information associated with the products, such depreciation to be assessed by us whose decision shall be final.

      The cooling off period is not applicable to watches purchased or collected from the Maidstone or London offices.

      Please note that the cooling off period is also not applicable where we adjust your watch to meet your specifications or personalise your watch in any way.

      To cancel a contract, please contact our Customer Services telephone line (0844 247 8884) or e-mail the sales advisor that dealt with your transaction.

    2. Faulty items

      We are confident that you will be happy with the quality of the products delivered to you. Nevertheless, as a consumer, you have legal rights in relation to products that are faulty or not as described. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office. Nothing in our terms and conditions will affect these legal rights.

      You must inspect the products as soon after delivery as is reasonably practicable and must notify us of any defects in the products within 14 working days from the day after the date the products were delivered. You must return any defective or faulty product to us within 21 working days from the date of delivery, to allow us to inspect the watch and carry out testing if required. Provided you notify us of any defects and return the defective product (complete with box and paperwork where applicable) within the periods set out above, on confirmation by us that the product is defective we will either replace your product on a like for like basis, repair your product or we will refund your payment in full including the product’s normal postage charge usually within 7 working days of the defective product being returned to us.

      If you buy more than one product from us as part of the same transaction, and only some of these products are defective, you may return the defective products and benefit from the same remedies as described above. However, this does not entitle you to reject other non-defective products.

    3. Our cancellation rights

      We may have to cancel an order for products before the products are delivered, for example, due to an event outside our control or the unavailability of stock. We will promptly contact you if this happens.

      If we have to cancel an order and you have made any payment in advance for products that have not been delivered to you, we will refund these amounts to you.

  8. PRIVACY
  9. Please review our Privacy Policy, which also governs your visit to Watchfinder.co.uk, to understand our practices.

  10. OUR LIABILITY
    1. Subject to the clause below, we shall under no circumstances whatever be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or any indirect or consequential loss arising under or in connection with a failure by us to comply with these terms and conditions; and our total liability to you in respect of all other losses arising under or in connection with the sale of the products, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the purchase price paid by you. Some jurisdictions do not allow the exclusion or limitation of liability for incidental or consequential damages, so the above exclusion may not apply to you, provided always that we will not be responsible for any incidental or consequential loss that is not reasonably foreseeable to both you and us when you commenced using the website or when you purchased an item from us.
    2. Nothing in the above clause shall limit or exclude our liability for: death or personal injury caused by our negligence, or the negligence of our employees, agents or subcontractors (as applicable); fraud or fraudulent misrepresentation; or any matter in respect of which it would be unlawful for us to exclude or restrict liability.

  11. EVENTS OUTSIDE OF OUR CONTROL
  12. We will not be responsible for any failure to perform, or delay in performance of, any of our obligations under these terms and conditions that is caused by events outside our reasonable control including without limitation Acts of God, fire, flood, severe weather, explosion, war, act of terrorism, industrial dispute (whether or not involving Watchfinder employees), or acts of local or central government or other competent authorities. This does not affect your statutory rights.

  13. COMMUNICATIONS BETWEEN US
    1. When we refer, in these terms and conditions, to "in writing", this will include e-mail.
    2. If you wish to contact us in writing, or if any clause in these terms and conditions requires you to give us notice in writing, you can send this to us by e-mail or by pre-paid post to Watchfinder.co.uk Limited at legal@watchfinder.co.uk or Invicta House, Pudding Lane, Maidstone, Kent, ME14 1NX. We will confirm receipt of this by contacting you in writing, normally by e-mail. If you are a consumer and exercising your right to cancel under paragraph 6(a), please see that paragraph 6(a) for how to tell us this.
    3. If we have to contact you or give you notice in writing, we will do so by e-mail or by pre-paid post to the address you provide to us in your order.

  14. WAIVER
    1. If we fail, at any time during the term of a contract, to insist upon strict performance of any of your obligations under the contract or any of these terms and, or if we fail to exercise any of the rights or remedies to which we are entitled under the contract, this will not constitute a waiver of such rights or remedies and will not relieve you from compliance with such obligations.
    2. A waiver by us of any default will not constitute a waiver of any subsequent default.
    3. No waiver by us of any of these terms and conditions will be effective unless it is expressly stated to be a waiver and is communicated to you in writing.

  15. SEVERABILITY
  16. If any court or competent authority decides that any of the provisions or paragraphs of these terms and conditions or any provisions of a contract are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.

  17. VARIATION
  18. No variation of this agreement shall be effective unless it is in writing and signed by the parties (or their authorised representatives).

  19. THIRD PARTY RIGHTS
    1. This contract is between you and us. No one other than a party to this agreement shall have any right to enforce any of its terms. The Contracts (Rights of Third Parties) Act 1999 is expressly excluded.
    2. However, the benefit of any warranty with the products may be transferred to another named recipient at the time of purchase with our consent (not to be unreasonably withheld), but we and you will not need their consent to cancel or make any changes to these terms and conditions. Please see the terms and conditions applicable to our warranty for further information.

  20. OUR RIGHT TO VARY THESE TERMS AND CONDITIONS
    1. We have the right to revise and amend these terms and conditions from time to time.
    2. You will be subject to the policies and terms and conditions in force at the time that you order products from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we agree to purchase your watch (in which case we have the right to assume that you have accepted the change to the terms and conditions).

  21. GOVERNING LAW AND JURISDICTION
    1. This agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
    2. The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this agreement or its subject matter or formation (including non-contractual disputes or claims).

Sell Your Watch

INTRODUCTION

These terms and conditions will apply to any contract between us for the sale of your watch either to us or through us. Please read these terms and conditions carefully and make sure that you understand them, before selling any items to us or through us. Please note that by selling us your watch or instructing us to sell your watch on your behalf, you agree to be bound by these terms and conditions and the other documents expressly referred to in it.

If you refuse to accept these terms and conditions, you will not be able to sell your watch to us or sell your watch via our website.

These terms and conditions should be read in conjunction with our “Privacy Policy” and “Terms of Website Use” terms and conditions.

Please note that these terms and conditions only apply to our consumer customers. If you are a business, you will be advised of the terms and conditions applicable.

  2. OUR CONTRACT WITH YOU
    1. If you would like to sell your watch, you can sell your watch either to us or through us. That is, you can sell your watch to us in an outright sale (“stock sale”). Alternatively, we can attempt to sell your watch to a customer on your behalf, for which we take a commission of the final sale proceeds (“commission sale”).
    2. If you would like to sell your watch on either a stock sale or commission sale basis, you will need to provide us with details of your watch, including its model, make and condition, by either entering details on the “Sell Your Watch” page on our website or by navigating through our catalogue on the “Sell Your Watch” page to find the watch you wish to sell.
    3. Please provide information about your watch fully and accurately. Any quotation, whilst given in good faith, is derived from a combination of factors including without limitation the information supplied by you. The provision of inaccurate, false or misleading information by you may result in an inaccurate valuation which cannot be relied upon by you.
    4. You will then receive either an e-mail with an initial valuation for a stock sale or an e-mail detailing the process for a commission sale. For a commission sale, we will usually suggest a sale price, which is calculated as a percentage of the current retail price.
    5. Any valuations are provided on a "subject to contract" basis and are not legally binding. We reserve the right to amend or withdraw the valuation at any time without liability to you. If we suggest a sale price for a commission sale, you are under no obligation to follow our suggestion.
    6. If you are happy with the initial valuation or commission process, then you will need to arrange for the watch to be posted to our offices in accordance with the clause governing “Delivery” below.
    7. On receipt of your watch at our offices, we will carry out an inspection of your watch and any accompanying paperwork. We will then contact you with a final valuation for your watch in the case of a stock sale or we will contact you with details of work required to be completed on your watch and their costs in the case of a commission sale. Notwithstanding any such inspection or testing, you shall remain fully responsible for the items and any inspection or testing shall not reduce or otherwise affect your obligations under the contract, including without limitation those listed under “Your Undertakings” below.
    8. A revised valuation may be offered where: (i) the watch does not fully comply with the information provided during the valuation process; (ii) the condition is such that it has a substantial impact on the value of the watch; (iii) other relevant factors not disclosed affect the valuation; and/or (iv) for any other reason.
    9. If you wish to proceed with a stock sale and accept our final valuation, we will arrange to pay you the agreed sum by bank transfer (see “Payment” below). The contract between us will only be formed when you have accepted the final price quoted. We will then send you an e-mail confirming when payment has been made, the sum paid and the payment method.
    10. You may purchase a watch from us in part-exchange of your current watch. The sale of your existing watch to us and your purchase of a watch from us shall be treated as separate contracts with the relevant terms and conditions applicable to each. In terms of the watch that you are selling to us in part-exchange, you are subject to these “Sell Your Watch” terms and conditions. In terms of the watch that you purchase from us, you are subject to our “Buy a Watch” terms and conditions. The contract between us under these terms and conditions will only be formed when you have accepted the final price quoted. For further information, please see “Part-Exchanges” below.
    11. If you wish to proceed with a commission sale, the contract between us will only be formed when we agree for work to be carried out on your watch (which, if required, must be agreed before listing on our website) and estimated costs of such works are also agreed or your watch is first advertised on our website, whichever is sooner. Please also see “Risk and Title” under “Delivery” below.
    12. Please note that if you visit the showroom in order to sell your watch, we will need you to produce two forms of original identification. For further information, please see “Identification” below. If you sell in person, we will provide you with a quotation and, if this is accepted by you, the contract will be formed on your signature of our standard receipt.
    13. You can keep track of the process by logging into your Watchfinder account. We will also keep you regularly updated by e-mail.

  3. PRICE AND PAYMENT
    1. The prices quoted by us and all payments made by us will be in Pounds Sterling. The price quoted will be net; please see the VAT margin scheme for further details. If you need to refund any sum to us, this will also be in Pounds Sterling. You will be responsible for the exchange rate and you are advised that refunds may be affected by such exchange rate.
    2. We will make payment to the bank account advised by you. Please note that you are responsible for ensuring the accuracy of your bank account details. We will not accept liability if you provide us with inaccurate bank details.
    3. Payment will be made by Banks Automated Clearance System (BACS) transfer and cleared funds may take approximately 7 working days to arrive after payment has become due. No liability is accepted by us for any delay which is unavoidable in the circumstances. We reserve the right to pay by any other payment method when and where reasonable. All bank details must be entered by you and you are responsible for the accuracy of these details.
    4. Payment to a nominated third party will generally be unacceptable. International sellers may be subject to an additional bank charge.
    5. In the event that we discover that the watch is counterfeit, lost, stolen or damaged or is not fully owned by you or any other undertaking provided by you under “Your Undertakings” is breached, we have the option without prejudice to any other rights and remedies we may have to rescind the contract(s) and, if we choose to exercise this right, we will notify you by telephone and/or by e-mail as soon as possible upon discovery by us. In this case, payment will not fall due. If we have already made payment, you must refund us the full purchase price paid within 7 days of receipt of notice from us. If the sale involved a part-exchange, please see “Part-Exchanges” below.
    6. If you sell your watch on a commission sale basis, then our fees and charges listed under “Commission Sale” below (paragraphs (a) and (b)) will apply. Please note that payment will only fall due after expiry of the 7 working day “cooling-off” period starting on the day after the customer receives the watch provided that the customer does not give notice to return the item during this period (again see “Commission Sale” below for further information).
    7. Any outstanding monies owed to us, including without limitation any servicing costs agreed between us, will be deducted from any payment to you.
    8. The price quoted excludes import duty or other taxes, fees and charges (see “Customs” below).
    9. You will pay all amounts due under these terms and conditions in full without any deduction or withholding except as required by law and you will not be entitled to assert any credit, set-off or counterclaim against us in order to justify withholding payment of any such amount in whole or in part. We may at any time, without limiting any other rights or remedies we may have, set off any amount owing to us by you against any amount payable by us to you.
    10. It is always possible that, despite our best efforts, we provide you with an incorrect valuation. If for some reason an error in the valuation quoted has occurred, we will rectify the valuation as soon as reasonably practicable after notification of the mistake. If the valuation error is obvious and unmistakeable and could have reasonably been recognised by you as a mispricing, we do not have to buy the items from you at the incorrect price. No liability whatsoever can be accepted by us for accidental mistakes or errors caused by system failures.

  4. COMMISSION SALES
    1. If you would like us to list your watch on our website and attempt to sell the item on your behalf, we will take a commission of the final sale proceeds. Our current commission is 10% of the final sale price (exclusive of postage and packaging) with a minimum charge applicable of £150.00. You will receive the final net sale price less our commission. The costs of any works carried out is then deducted (see (b) below) from this sum.
    2. Watches must meet our standards before they may be listed on our website. On assessment of your watch, we will determine what work (if any) must be carried out on your watch prior to listing on our website. The details and estimated costs of any work required will be added to your online Watchfinder account for your approval.
    3. You must also set your preferred sale price before your watch will be listed on our website. You will have an opportunity to enter a minimum sale price, which is not compulsory but is recommended.
    4. Once you set the sale price(s) and have accepted the works required to be completed and the costs of such works (where applicable), we will list your watch on our website. We may initially list your watch with a “pre-refurbishment” image, which will be replaced with a post-refurbishment image as soon as the works are complete. We reserve the right to remove your watch from our website for any reason and at any time. We will promptly notify you in the event that such action is deemed necessary.
    5. By setting a preferred sale price (compulsory) and minimum sale price (optional), you authorise us to proceed to sell the item on your behalf if an offer is made at or above the preferred or minimum sale price. If an offer below your minimum sale price is made (or your preferred sale price in the absence of a minimum sale price), we will seek to contact you before proceeding. If we cannot contact you, we will not proceed with the sale. We will provide you with e-mail confirmation if we successfully sell your watch at the preferred or minimum sale price.
    6. Online customers are entitled to a 7 working day “cooling off” period by law, starting on the day after the customer receives the item. If a customer exercises their right to cancel the contract during this period, you will be notified of this and your watch relisted on our website on its return to our offices following inspection to ensure the watch is in the same condition. No payment will be due to you. If no notice of cancellation is received during this period and the transaction is not cancelled as a result of a defect with the watch (see “The Items” below), we will arrange for payment to be made to you by BACS transfer (please see “Payment” above) within 14 working days of the expiry of the “cooling off” period. Please note that this clause applies regardless of whether or not the customer purchased and/or collected the watch from one of our showrooms. Please also note that time of dispatch of the item to the customer shall not be of the essence, and in particular we have standard procedures that we must follow before we can dispatch an item (including without limitation confirmation of address by the customer).
    7. We do not accept liability for a delay in the return of the watch from the customer to our offices where notice has been given by the customer to return the watch.
    8. Where you authorise (whether orally or in writing, which shall include e-mail correspondence) any servicing, refurbishment or other work to be carried out on your watch, you will be charged the agreed price, regardless of whether or not the watch is subsequently sold. Estimates by us are given in good faith, but are estimates only. Where the watch is not sold, we will return the watch to you on receipt of cleared funds only (please see "Lien" below).
    9. If we arrange for a third party to prepare a quotation for servicing or other work to be carried out on your watch on your instruction, but you do not proceed with the work in question, an administrative charge may apply.
    10. Watches are precision instruments with moving parts. Wear and tear is the unavoidable result of any mechanical movement. In time, all mechanical watches will need a service to ensure they continue to work to the highest level. This period of time depends on, amongst other things, the brand and model, but it is recommended that all watches are serviced every 3 to 4 years to maintain their level of accuracy. As watches can be held in our possession for some time before being sold and dispatched, please note that watches may on occasion require servicing or other work between the period of arrival with us and sale. Any such work deemed necessary by us will be at your cost.
    11. If you would like your watch to stand out on our website, you may wish to consider our premium commission package at a cost of £50.00. This includes rotating images of your watch and a bespoke description written by one of our watch experts.
    12. Please note that we reserve the right to vary our commission structure at any time. We cannot vary the commission payable by you once the watch has been sold to a customer, regardless of whether payment has been made to you. If we notify you that we would like to increase the commission payable by you to us prior to sale, and you would not like to proceed on that basis, please notify us of this within 1 week of the notification to you and we will remove your watch from our site and return it to you. If you accept an offer by a customer at any time after the revised level of commission has been notified to you, you are deemed to accept the revised level of commission.
    13. If you wish to sell your watch on a commission basis, in addition to advertising your watch for sale on our website (or other selected websites), we reserve the right to store and display your watch at any of our offices, showrooms or shops and to display your watch for sale at select events without notice.

  5. DELIVERY
    1. You will deliver the items:
      1. to our premises at Invicta House, Pudding Lane, Maidstone, Kent, ME14 1NX or as instructed by us prior to delivery (Delivery Location); and
      2. during our normal business hours or as instructed by us.
    2. Carriage, packing, insurance and any taxes or charges applicable shall be your responsibility and at your cost unless agreed otherwise (also see “Customs” below).
    3. You will ensure that the items are properly packed and secured in such manner as to enable the items to withstand the normal rigours of transit and reach the Delivery Location in good condition.
    4. Once you have accepted our initial valuation for your item or opt to proceed with a commission sale, a delivery note will be generated by us and you will be e-mailed a link to access and print this note. All items posted to us should be accompanied by a delivery note. If your item is not accompanied by our delivery note, there could be a delay in processing your item on arrival at the Delivery Location.
    5. You must deliver the items to the Delivery Location at your own risk. We suggest that you obtain proof of posting. If you decide not to proceed with a sale and are based within the UK, we will not make a charge for the postage, packaging and insurance costs of returning the items to you, unless we are returning the watch to you as a result of a breach of an undertaking under “Your Undertakings” (we will return counterfeit items free of charge using the regular post if you are based in the UK, but will make a charge of approximately £20.00 if instructed by you to return your item using the Royal Mail Special DeliveryTM service to addresses in the UK. If you are based outside of the UK, a courier will be selected at our discretion and postage costs will be payable by you.)
    6. Delivery of the items will be completed on the completion of unloading the items at the Delivery Location.
    7. Once at the Delivery Location, we will confirm receipt of your watch and it will be inspected. This will usually take no more than 48 hours.
    8. In exceptional circumstances and only by prior agreement, we may agree to collect the items directly from you. We may make a charge for this service.

      Risk and title
      1. Your watch will be our responsibility from the time of delivery to the Delivery Location.
    9. In terms of ownership of the watch:
      1. Stock sale: Ownership of the watch will pass from you to us when the contract is concluded between us as described above under “Our Contract With You”.
      2. Commission sale: Ownership of the watch will pass from you to the end customer only after the expiry of the cooling-off period afforded to customers pursuant to the Consumer Protection (Distance Selling) Regulations 2002 if we have not received notice of cancellation by the customer during this period and the transaction is not cancelled as a result of a defect with the watch (see “The Items” below), provided always that you shall have no right to cancel an order by the end customer once it has been confirmed with us.

  6. CUSTOMS
  7. If you are based outside of the UK, you may also have to pay export duty or other taxes, fees and charges applied by customs or other authorities. You must comply with all laws and regulations of your country. Any additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. If you are unsure about whether these charges might apply to your order, you should contact your local tax or customs office for further information.

  8. THE ITEMS
  9. You will ensure that the items will:

    1. correspond with their description;
    2. be of satisfactory quality (within the meaning of the Sale of Goods Act 1979, as amended) and fit for any purpose held out by you or made known to you by us expressly or by implication, and in this respect we rely on your skill and judgement; and
    3. be free from defects in design, material and workmanship.

  10. YOUR UNDERTAKINGS
  11. You confirm that:

    Information supplied by you

    1. all the information supplied by you to us before conclusion of a contract under “Our Contract With You” above is true, accurate and complete;
    2. you have not concealed any fact or matter concerning the identity, quality, history, provenance, authenticity, legal status or general character of the watch, which might be regarded by a reasonable buyer in our position as material to, or otherwise liable to influence, the decision to buy the watch;
    3. Title

    4. the watch is your property and that you are entitled to sell the watch free from any charge, lien, burden or adverse claim, including all hire. In particular:
      1. the watch has not been reported to the manufacturer, police or any other authority as lost or stolen;
      2. the watch is not subject to an undisclosed finance agreement; and
      3. no other person has any claim to the watch, whether legal, equitable, possessory or otherwise;
    5. Condition

    6. there are no undisclosed physical defects with the watch;
    7. the watch has not been an insurance “write-off” or subject to substantial remedial repairs;
    8. the watch has not been altered or tampered with;
    9. Authenticity and provenance

    10. you accept that every element in the description of the watch, including its make, model and serial number, is a material and essential part of its identity and that the absence or non-fulfilment of any such element renders the watch in the perception of us and you radically and fundamentally different from the watch that you have agreed to supply; and
    11. the serial numbers and documentation are original, genuine and accurate.

    You are fully responsible for any breach of the preceding conditions and remain so until discovery of such breach by us.

  12. REMEDIES
    1. If the items do not comply with the undertakings set out in “Your Undertakings”, then, without limiting any of our other rights or remedies, we will have the right to any one or more of the following remedies, whether or not we have accepted the items:
      1. to terminate the contract;
      2. to reject the items (in whole or in part) and return them to you at your own risk and expense;
      3. to require you to provide a full refund of the price of the rejected items (if paid);
      4. to recover from you any costs incurred by us in obtaining substitute items from a third party; and
      5. to claim damages for any other costs, loss or expenses incurred by us which are in any way attributable to your failure to carry out your obligations under the contract.
    2. Our rights and remedies under these terms and conditions are in addition to our rights and remedies implied by statute and common law.

  13. LIEN
  14. Without prejudice to any of our other rights or remedies, we shall have a general and particular lien over all items in our possession which are the property of you to secure payment by you of all sums due from you to us under any contract whatsoever.

  15. PART-EXCHANGES
    1. For details of how the contract is made and the terms and conditions applicable, please see “Our Contract With You” above.
    2. A part-exchange allowance will be agreed between us in writing, which will be used as part payment towards your purchase order. If an order is cancelled in which a part-exchange is involved, we may at our sole discretion offer either a return of your watch or payment of the part exchange allowance.
    3. In the event that we discover that the watch you are selling us in part-exchange is counterfeit, lost, stolen or damaged or is not fully owned by you or any other undertaking provided by you under “Your Undertakings” is breached, we have the option to rescind either or both contracts and, if we choose to exercise this right, we will notify you by telephone and/or by e-mail as soon as possible upon discovery by us. In this case, you must refund us all sums paid by us to you within 7 days of receipt of notice from us. If we have already dispatched the watch you sought to purchase from us, you will further need to either return this watch to us or pay us the full purchase price for this watch.
    4. Where your part exchange allowance exceeds the purchase price of the watch you are agreeing to buy, we will issue you with the appropriate credit by bank transfer, subject to our usual terms and conditions relating to payments. Where your part exchange allowance is less than the purchase price of the watch you are agreeing to buy, you will need to pay the outstanding balance by bank transfer or such other method as agreed by both parties.

  16. PROOF OF IDENTITY
    1. If you visit our offices in order to sell your watch, we will need you to produce two forms of original identification during your visit. We must be provided with acceptable means of identification before we can process any payment to you, in view of our money laundering and counterfeit item policies. We will take copies of this identification for our records.
    2. It will be necessary for you to produce the original of one document from each of the following two categories:

      Proof of identity

      1. Current valid passport
      2. Current driving licence
      3. Other (e.g. known employer identity card with photo and signature)

      Proof of address

      1. Recent utility bill
      2. Council tax bill
      3. Bank statement

  17. LOSS OR DAMAGE
    1. If any item you have posted to us is lost or damaged while it is with us, and you provide satisfactory proof that you posted it and we received it, we will attempt to find a suitable like-for-like replacement but, if unsuccessful, we will pay you compensation for the item based on the actual loss you suffer. The compensation will not exceed the latest price quoted by us to you for purchasing the item or the trade valuation price (whichever is applicable) at the time the item was lost or damaged less any of our costs including without limitation servicing fees.
    2. We will transfer the full settlement sum due to you on receipt of the same from our insurers, provided always that you will receive all amounts due within 30 days of notification by us to you of the loss or damage.

  18. PRIVACY
  19. Please review our Privacy Policy, which also governs your visit to Watchfinder.co.uk, to understand our practices.

  20. OUR LIABILITY
    1. Subject to the clause below, we shall under no circumstances whatever be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or any indirect or consequential loss arising under or in connection with a failure by us to comply with these terms and conditions; and our total liability to you in respect of all other losses arising under or in connection with the sale by you of the items (whether as a stock sale or commission sale), whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the latest price quoted by us to purchase your watch from you or the trade valuation (whichever is relevant). Some jurisdictions do not allow the exclusion or limitation of liability for incidental or consequential damages, so the above exclusion may not apply to you, provided always that we will not be responsible for any incidental or consequential loss that is not reasonably foreseeable to both you and us when you commenced using the website or when you sold an item either to or through us.
    2. Nothing in the above clause shall limit or exclude our liability for: death or personal injury caused by our negligence, or the negligence of our employees, agents or subcontractors (as applicable); fraud or fraudulent misrepresentation; or any matter in respect of which it would be unlawful for us to exclude or restrict liability.

  21. ENTIRE AGREEMENT
    1. This agreement constitutes the entire agreement between the parties and supersedes and extinguishes all previous drafts, agreements, arrangements and understandings between them, whether written or oral, relating to its subject matter.
    2. Each party agrees that it shall have no remedies in respect of any representation or warranty (whether made innocently or negligently) that is not set out in this agreement. No party shall have any claim for innocent or negligent misrepresentation based upon any statement in this agreement.

  22. CONFLICT WITH OTHER AGREEMENTS
  23. This contract constitutes the entire agreement between the parties. If there is any inconsistency between other communications and these terms and conditions, the latter shall prevail. You acknowledge that you have not relied on any statement, promise or representation made or given by or on behalf of us which is not set out in these terms and conditions.

  24. NO PARTNERSHIP OR AGENCY
  25. Except as expressly provided, nothing in these terms and conditions is intended to, or shall be deemed to, establish any partnership or joint venture between the parties, constitute either party the agent of the other, nor authorise a party to make or enter into any commitments for or on behalf of the other party.

  26. EVENTS OUTSIDE OF OUR CONTROL
  27. We will not be responsible for any failure to perform, or delay in performance of, any of our obligations under these terms and conditions that is caused by events outside our reasonable control including without limitation Acts of God, fire, flood, severe weather, explosion, war, act of terrorism, industrial dispute (whether or not involving Watchfinder employees), or acts of local or central government or other competent authorities. This does not affect your statutory rights.

  28. COMMUNICATIONS BETWEEN US
    1. When we refer, in these terms and conditions, to "in writing", this will include e-mail.
    2. If you wish to contact us in writing, or if any clause in these terms and conditions requires you to give us notice in writing, you can send this to us by e-mail or by pre-paid post to Watchfinder.co.uk Limited at legal@watchfinder.co.uk or Invicta House, Pudding Lane, Maidstone, Kent, ME14 1NX. We will confirm receipt of this by contacting you in writing, normally by e-mail.
    3. If we have to contact you or give you notice in writing, we will do so by e-mail or by pre-paid post to the address you provide to us in your order.

  29. WAIVER
    1. If we fail, at any time during the term of a contract, to insist upon strict performance of any of your obligations under the contract or any of these terms and, or if we fail to exercise any of the rights or remedies to which we are entitled under the contract, this will not constitute a waiver of such rights or remedies and will not relieve you from compliance with such obligations.
    2. A waiver by us of any default will not constitute a waiver of any subsequent default.
    3. No waiver by us of any of these terms and conditions will be effective unless it is expressly stated to be a waiver and is communicated to you in writing.

  30. SEVERABILITY
  31. If any court or competent authority decides that any of the provisions or paragraphs of these terms and conditions or any provisions of a contract are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.

  32. VARIATION
  33. No variation of this agreement shall be effective unless it is in writing and signed by the parties (or their authorised representatives).

  34. THIRD PARTY RIGHTS
  35. This contract is between you and us. No one other than a party to this agreement shall have any right to enforce any of its terms. The Contracts (Rights of Third Parties) Act 1999 is expressly excluded.

  36. OUR RIGHT TO VARY THESE TERMS AND CONDITIONS
    1. We have the right to revise and amend these terms and conditions from time to time.
    2. You will be subject to the policies and terms and conditions in force at the time that you agree to our terms and conditions, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before you agree to proceed with a stock sale or a commission sale (in which case we have the right to assume that you have accepted the change to the terms and conditions).

  37. GOVERNING LAW AND JURISDICTION
    1. This agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
    2. The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this agreement or its subject matter or formation (including non-contractual disputes or claims).

  38. OUR DETAILS

"Watchfinder" is a trading name of Watchfinder.co.uk Limited, whose registered office is at 37 St. Margarets Street, Canterbury, Kent CT1 2TU, registered in England & Wales under company registration number 04524723.     If you are a consumer, nothing in these terms and conditions will affect your statutory rights.

Buy Back Guarantee

Your watch is accompanied by our buy back guarantee, which means that we guarantee to purchase your watch from you for a sum of at least the value advised to you at the time of purchase (the “Offered Price”) on or after two years following your purchase of the watch from us, subject to the following terms and conditions.

The buy back guarantee is subject to us inspecting your watch and your watch being returned us in good and saleable condition with all associated boxes and paperwork. Any devaluation as a result of a missing box and/or paperwork will lead to a deduction from the Offered Price. Any servicing or refurbishment work deemed as necessary by us will be deducted from the Offered Price. In particular, we may make deductions from the Offered Price for wear of the watch strap, glass, clasp and other cosmetic damage, as well as normal wear-and-tear and damage caused to your watch by accidents, mishandling, mistreatment or negligence.

In order to maintain your buy back guarantee, you will need to follow our registration procedure as will be advised to you. You will also need to return your watch to us at least once every 2 years from and including the date of purchase so that we may carry out a health check on your watch (date of purchase means the date that we receive full and cleared funds for the purchase price of your watch; where you pay by instalments, this is the date we receive the final balance payment*). For example, if we receive your final payment on 05 February 2012, you will need to return your watch to us so that we receive it by 04 February 2014 and then subsequently at two-yearly intervals i.e. by 04 February 2016, 04 February 2018 etc.) Please note that for the purposes of your free health check, the earliest date on which we will accept your watch is 1 calendar month prior to the relevant due date (so, in the example above for the first health check, 04 January 2014). We will endeavour to send you reminders prior to each health check due date, though are under no obligation to do so.

The buy back guarantee will be invalidated in the event that a third party carries out any tests or work on your watch (including, without limitation, dismantling your watch to carry out an inspection) without our prior knowledge and consent.

The use of aftermarket components can severely compromise the technical performance, reliability and waterproofness of your watch. Any modification of your watch by the addition or substitution of components by aftermarket products that have not been provided by the manufacturer will invalidate the buy back guarantee.

If your health check reveals any issue with your watch that is covered by our warranty (please see our full warranty terms and conditions), then we will notify you accordingly and, on your instruction, carry out our recommended works free of charge. We will not be liable for the costs of any service and/or repair work revealed as necessary following the health check carried out by us if such work is not covered by the terms of our warranty.

Please note that you must securely deliver the watch to our appropriate service centre as advised and with adequate insurance, whether for the health check or to return your watch under the buy back scheme or for any other reason, which shall be your responsibility and at your cost unless stated otherwise. If you are based in the UK and you have returned your watch to us for the free health check, we will not make a charge for the postage and packaging costs of returning the watch to you. We will charge for postage and packaging and all other taxes, fees and charges applied by customs incurred for returning your watch to you if you are based outside of the UK.

Your buy back guarantee is personal to you and is non-transferable.

* Where you enter into a finance agreement, the date of purchase means the date we receive the first balance payment in full and cleared funds from the finance company.

Care Package

One free health check within the Watchfinder warranty period, during which Watchfinder will inspect your watch and use its reasonable endeavours to diagnose any issues with your watch. The watch must be delivered by the member to premises designated by Watchfinder in the usual way. The watch is your responsibility until it reaches our office. Please ensure you package your watch to prevent any damage to the item. We recommend you obtain proof of posting. All deliveries and insurance costs of the watch while in transit are at the customer's expense. Watchfinder shall not be liable for the repair of any watch which is revealed as required as a result of Watchfinder carrying out the health check.

One free watch refurbishment within the warranty period for a standard, steel polish, up to and including the value of £50.00. We reserve the right to refuse to refurbish a watch if our servicing technicians are of the view that a refurbishment could prove detrimental to or damage the watch. For this reason, we may refuse to refurbish white gold watches at our discretion.

You benefit from a two year warranty, which is otherwise subject to the same terms and conditions as our standard 12 month warranty. Please see "Warranty" terms and conditions for full details.

Members

Introduction

These terms and conditions (together with the documents expressly referred to in it) will apply to your membership with us. It is important that you read and understand these terms and conditions. By agreeing to become a member, you agree to be legally bound by these terms and conditions and the other documents expressly referred to in it.

If you refuse to accept these terms and conditions, you will not be able to become a member.

  1. Applying
    1. To become a member, you must be aged 18 years or over.
    2. We reserve the right to refuse any application for membership for any reason whatsoever, including without limitation if required to do so by law.
    3. A member shall be the person to whom a Watchfinder membership ID number is issued following payment of the applicable membership fee to Watchfinder.

  2. Important terms
    1. Membership is personal to you and cannot be sold or transferred.
    2. Your subscription fee is non-refundable.
    3. Your membership will be registered to your current postal address. To ensure your membership remains valid, please make sure that you inform us of any changes to your contact details without delay, including your full name, postal address, email address and telephone number.
    4. You may only use your membership card for the purposes for which it is issued and you must inform us if it is lost or stolen without delay. The membership card is and shall remain our property and is not for resale or publication. If you need a replacement card to be issued to you, we reserve the right to charge a £10 replacement fee per card.
    5. In order to provide you with the best possible range of services and benefits, these are continually reviewed. All benefits are subject to availability and may change from time to time without notice. Members are entitled to receive benefits as they may be varied from time to time.   3. Subscription fees
  4. To become a member, a one-off subscription fee is payable. For a list of our current membership fees, please visit www.watchfinder.co.uk/members. This entitles you to a lifetime membership from the date of receipt of your subscription, unless and until membership is terminated in accordance with these terms and conditions.

  5. Benefits
  6. 24 MONTH WARRANTY

    Any watch you purchase from us after you join will benefit from a 24 month warranty. Please see full terms and conditions applicable to your warranty (which are the same as our standard 12 month warranty, save as to the duration), available at www.watchfinder.co.uk/termsandconditions.

    HEALTH CHECK

    Have your watch evaluated for condition and accuracy by an experienced watch technician. You may redeem your free health check once during the period of your membership for each watch in your collection.

    Please note that you must securely deliver the watch to our service centre as advised and with adequate insurance, which shall be your responsibility and at your cost unless stated otherwise. If you are based in the UK, we will not make a charge for the postage, packaging and insurance costs of returning the watch to you.

    REFURBISHMENT

    Have your watch refurbished by one of our in-house watch technicians. Redeemable once and at any point during the membership period for each watch in your collection.

    You will receive free battery changes for life on any battery powered quartz movement watch you purchase from us. This could save you £40.00 each time you require a battery replacement. Please note that if your watch needs to be resealed, this may incur a charge.

    WATCH VALUATIONS

    If you need a written valuation for your insurers, we will provide one for you free of charge for watches purchased from us. We will carry out a free insurance valuation for other watches which are part of your collection if each watch has a minimum retail value of £500.00. We are a member of the Guild of Valuers and Jewellers. Each valuation usually costs £25.00 per watch. Please note that we can only provide a valuation if we physically inspect the watch.

    PRICE MATCHING

    Take part in our price match scheme in respect of pre-owned watches. In the unlikely event that you find the same watch for a lower price, we will match the price of any genuine like for like item within the UK, provided that we have the same watch in stock. In order to make a claim, a member must provide us with: (1) your membership ID number; (2) the full description of the watch, including its: make, model number, model description, age, condition, information as to whether it is accompanied by a warranty (and length of warranty) and whether it is accompanied by the manufacturer's original paperwork (3) the supplier name; (4) website address and/or telephone number (for example, a member can send either a link or a screen shot); and (5) where and when you saw the watch advertised. Prices and watches must be available for checking via internet, phone or written quotations with clear evidence of where the quote originates. Only recognised and reputable watch retailers will be considered, and online auctions sites such as eBay are expressly excluded from the price match scheme. Price match does not apply to promotional products or items on sale. All watches must have first been marketed in the EEC; price match does not apply to any watches sold in the "grey market." All other offers and promotions will not apply to an order subject to our price match scheme. Please note that we will not price match and no full or partial refund will be made if a member has already purchased the watch from us before making a claim under the price match scheme. If we suspect any false or fraudulent claim or that the spirit of the price match scheme is being abused, we reserve the right to refuse to price match. Once we have established that the watches are the same, including but not limited to the same brand, model, material, age, condition and warranty (which should be equivalent in protection offered and duration), we will match the price, provided always that the decision to price match is at the discretion of our sales staff, whose decision to price match or not is final.

  7. Term and cancellation of membership
    1. We reserve the right at our sole discretion to immediately terminate your membership, as well as suspend or cease to provide member benefits, for any reason including without limitation if: you fail to comply with any of these terms and conditions of membership; you fail to pay any sums due to us or any associated company; we suspect fraud or abuse of club membership; you bring any claims against us; or if required to do so by law.
    2. You may cancel your membership by giving 2 months written notice (which includes email) of cancellation to us (Watchfinder: Watchfinder.co.uk Limited, Invicta House, Pudding Lane, Maidstone, Kent, ME14 1NX or membership@watchfinder.co.uk, or to such other address as notified to you). However, no refund will be made in whole or in part to members of subscription fees paid to the date of termination.

  8. Changes to membership terms and conditions
    1. These terms and conditions and benefits may change from time to time with or without notice at our discretion. You are advised to check the list of benefits available from time to time on our website (www.watchfinder.co.uk).
    2. Your continued membership or use of your membership constitutes acceptance of revised terms and conditions.

  9. Our liability
    1. Subject to the clause below, we shall under no circumstances whatever be liable to the member, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or any indirect or consequential loss arising under or in connection with the membership; and our total liability to the member in respect of all other losses arising under or in connection with the membership, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the annual membership fee paid by the member. Some jurisdictions do not allow the exclusion or limitation of liability for incidental or consequential damages, so the above exclusion may not apply to you, provided always that we will not be responsible for any incidental or consequential loss that is not reasonably foreseeable to both you and us when you commenced using the website or when you became a member.
    2. Nothing in the above clause shall limit or exclude our liability for: death or personal injury caused by its negligence, or the negligence of its employees, agents or subcontractors (as applicable); fraud or fraudulent misrepresentation; or any matter in respect of which it would be unlawful for us to exclude or restrict liability.

  10. Privacy notice
    1. Watchfinder.co.uk Limited of 37 St Margarets Street, Canterbury, Kent, CT1 2TU is the data controller for the purpose of the Data Protection Act 1998.
    2. By proceeding to become a member you consent that we may process the personal data (including sensitive personal data) that we collect from you in accordance with our Privacy Policy (http://www.watchfinder.co.uk/termsandconditions). In particular, we may use information we hold about you to the extent reasonably necessary to provide members with offers, products and/or services offered by us from time to time, and information in relation to the aforesaid.
    3. Please address any questions, comments and requests regarding our data processing practices to legal@watchfinder.co.uk.

  11. Entire agreement
  12. These terms and conditions constitute the entire agreement between the parties and supersedes and extinguishes all previous agreements, arrangements and understandings between them, whether written or oral, relating to its subject matter, except where additional terms and conditions are expressed to apply by Watchfinder in this agreement.   13. Waiver
  14. No failure or delay by a party to exercise any right or remedy provided under these terms and conditions or by law shall constitute a waiver of that or any other right or remedy, nor shall it preclude or restrict the further exercise of that or any other right or remedy. No single or partial exercise of such right or remedy shall preclude or restrict the further exercise of that or any other right or remedy.

  15. Severance
    1. If any court or competent authority finds that any provision of these terms and conditions (or part of any provision) is invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of these terms and conditions shall not be affected.
    2. If any invalid, unenforceable or illegal provision of these terms and conditions would be valid, enforceable and legal if some part of it were deleted, the provision shall apply with the minimum modification necessary to make it legal, valid and enforceable.

  16. Third party rights
    1. A person who is not a party to this agreement shall not have any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement.
    2. The rights of the parties to terminate, rescind or agree any variation, waiver or settlement under this agreement are not subject to the consent of any person that is not party to this agreement.

  17. Governing law and jurisdiction
    1. This agreement and any dispute or claim arising out of or in accordance with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with English law.
    2. The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this agreement or its subject matter or formation.

Warranty

All our watches are accompanied by our 12 month warranty (the "Warranty"), protecting your watch against manufacturing and mechanical defects, subject to the following terms and conditions.

Your Warranty will be registered to your current postal address. To ensure your Warranty remains valid, please make sure that you inform us of any changes to your contact details without delay, including your full name, postal address, email address and telephone number.

The Warranty does not cover theft or loss of your watch, normal wear-and-tear, damage caused to your watch by accidents, mishandling, mistreatment or negligence (including, without limitation, damage caused by failure to follow manufacturer and/or our instructions.) In particular, wear of the watch strap, glass, clasp and cosmetic damage are not covered by our Warranty.

If your watch is returned to us due to a valid claim against our Warranty whilst it is still protected by the manufacturer warranty, we reserve the right to proceed with the works through the manufacturer warranty in the first instance.

Your Warranty will be invalidated in the event that a third party carries out any tests or work on your watch (including, without limitation, dismantling your watch to carry out an inspection) without our prior knowledge and consent.

The use of aftermarket components can severely compromise the technical performance, reliability and waterproofness of your watch. Any modification of your watch by the addition or substitution of components by aftermarket products that have not been provided by the manufacturer will invalidate your Warranty.

In the event of a claim against your Warranty, we will refund, repair or replace your watch at our sole discretion. Time will not be of the essence for completion of any works carried out under Warranty.

We have the final decision on all claims against our Warranty. If any dispute arises in connection with the Warranty, we reserve the right to instruct an independent third party watchmaker nominated by us to determine the issues in dispute, though are under no obligation to do so. The conclusion in the report to be provided by the third party will be binding as between the parties. Please note that the recommendations of the manufacturer are expressly excluded for the purposes of our Warranty, where such recommendations conflict with our advice.

If you are based outside of the United Kingdom, you may have to pay import duty or other taxes, fees and charges applied by customs or other authorities of your country for work done under Warranty, particularly if you do not correctly complete the relevant declarations.

Please note that you must securely deliver the watch to our appropriate service centre as advised and with adequate insurance, whether for the health check or to claim against your Warranty or for any other reason, which shall be your responsibility and at your cost unless stated otherwise. If you are based in the UK and have a valid claim against your Warranty, we will not make a charge for the postage and packaging costs of returning the watch to you (unless the work involves battery replacement only). We will charge for postage and packaging and all other taxes, fees and charges applied by customs incurred for work carried out under Warranty if you are based outside of the UK.

Your Warranty is personal to you and is non-transferable. The Warranty is in addition to your statutory and common law rights.

* Where you enter into a finance agreement, the date of purchase means the date we receive the final balance payment in full and cleared funds from the finance company.

Valuations

If Watchfinder is instructed by a customer to carry out such a valuation, the following terms and conditions apply:

  1. Watchfinder must physically inspect the watch.
  2. The watch must be delivered by the customer to premises designated by Watchfinder.
  3. The watch is your responsibility until it reaches our office. Please ensure you package your watch to prevent any damage to the item. We recommend you obtain proof of posting.
  4. All deliveries and insurance costs of the watch while in transit are at the customer's expense.
  5. Watchfinder will not be bound by any description provided or assumed by either party which, after investigation, proves to be different from that stated on submission of the watch by the customer.
  6. A Watchfinder valuation will not prove to verify the provenance of the customer's watch.
  7. Watchfinder shall not be liable for the repair of any watch which is revealed as required as a result of Watchfinder carrying out the valuation procedure.
  8. The customer shall provide Watchfinder without delay any information that Watchfinder reasonably requires in order to complete the valuation process, which shall include an on-going obligation on the customer to provide Watchfinder without delay any information which could affect the level of valuation, and shall inform Watchfinder without delay in the case of any discrepancy between a Watchfinder valuation and valuations carried out by other parties.
  9. Watchfinder reserves the right at its sole discretion to decline to accept any instruction by a customer for a watch valuation.

SERVICING AND REFURBISHMENTS

INTRODUCTION

These terms and conditions will apply to any contract between us for the refurbishment or servicing of your watch that either we carry out for you or we instruct to be carried out on your behalf. Please read these terms and conditions carefully and make sure that you understand them, before requesting a quotation or sending your watch to us. Please note that by delivering your watch to us, you agree to be bound by these terms and conditions and any other documents expressly referred to in it. If you refuse to accept these terms and conditions, we are afraid that we cannot service or arrange the service of your watch for you.

These terms and conditions should be read in conjunction with any other terms and conditions referred to in this document.

Please note that these terms and conditions only apply to our consumer customers. If you are a business, you will be advised of the terms and conditions applicable.

Clause 5 below includes important limitations of our liability for work carried out by us and work carried out by third parties.

  1. INTERPRETATION
    1. The following definitions and rules of interpretation apply in these terms and conditions:

      Our website(s), the website(s): the website at the domain http://www.watchfinder.co.uk and/or the website at the domain http://www.timeservices.co.uk.
      Refurbishment(s), refurbished: a valet service of your watch, as more particularly described below.
      Servicing, service(s), serviced: servicing of your watch, which may or may not involve an overhaul of the movement of your watch, the addition or substitution of parts to your watch or other work, which may be carried out either by our in-house team of watchmakers and technicians or a third party, as agreed.
      Watch(es), item(s): the watch (or any part of it) that you wish to be refurbished or serviced.
      We, us, our: Watchfinder.co.uk Limited t/as Watchfinder or Time Services (registered in England and Wales with company number 04524723).
      Work(s): refurbishment and/or servicing work as applicable.
      You, your: the person or other entity that wishes for us to carry out work on your watch.
    2. Clause headings shall not affect the interpretation of these terms and conditions.
    3. Unless the context otherwise requires, words in the singular shall include the plural and in the plural shall include the singular.
  2. OUR SERVICES
    1. We offer the following services, subject to clauses 2(b) to 2(e):
      1. Refurbishments: We will use reasonable endeavours to clean and restore shine to your watch with a valet service. All refurbishments are carried out by one of our in-house watch technicians using reasonable care and skill. Refurbishments are not carried out by other parties, including but not limited to manufacturers. Unfortunately, we cannot refurbish white gold watches.
      2. Our servicing: If you wish for us to service your watch, we will assess your watch on receipt and provide you with a detailed breakdown of the work that we feel are required. Once we have provided you with a quotation, no work will be started until you authorise the work orally or in writing. We will use reasonable endeavours to service your watch in accordance with our agreed schedule of work in all material respects using reasonable care and skill. Any work we carry out (excluding without limitation work carried out under warranty) which involves a full service including a complete overhaul of the movement will entitle you to a 24-month warranty (please see our “Warranty” terms and conditions for terms applicable to our warranties).
      3. Commission service: In the case of work carried out on your watch pursuant to your use of our commission service (whether servicing or refurbishment work and whether carried out by us or a third party), the relevant sections of these terms and conditions and our “Sell Your Watch” terms and conditions shall apply and if there is any inconsistency between these terms and conditions and our “Sell Your Watch” terms and conditions, the latter shall prevail. You acknowledge that you have not relied on any statement, promise or representation made or given by or on behalf of us that is not set out in these terms and conditions.
      4. Our warranty: In the case of work carried out under our warranty (whether servicing or refurbishment work carried out by us), the relevant sections of these terms and conditions and our “Warranty” terms and conditions shall apply and if there is any inconsistency between these terms and conditions and our “Warranty” terms and conditions, the latter shall prevail. You acknowledge that you have not relied on any statement, promise or representation made or given by or on behalf of us that is not set out in these terms and conditions.
      5. Third party work: While we will make reasonable efforts to ensure reasonable standards of skills, integrity and reliability in the third parties we instruct to carry out work on your watch on your behalf and to comply with your requirements, you accept and agree that we give no warranty as to the suitability of any third party for any work. Depending on the third party and work undertaken on your watch, you may benefit from a guarantee or warranty provided by the third party, which will be advised to you. We are afraid that we do not guarantee the work carried out by third parties.
    2. We reserve the right to refuse to carry out or arrange the refurbishment or service of your watch and provide you with a full refund if you have paid us in advance in the event that we feel we should not carry out work on your watch for any reason, unless you have a valid warranty claim.
    3. If your watch requires other work in addition to the work requested, we will endeavour to notify you of such work and arrange for a quotation where requested though are under no obligation to do so.
    4. We shall use reasonable endeavours to meet any anticipated completion date, but all dates quoted for completion of the work are estimates only and time shall not be of the essence.
    5. If work carried out on your watch involves the removal or replacement of components of your watch and you request the return of the original components to you, we will use reasonable endeavours to comply with your request though are under no obligation to do so. In particular, we have no control over third parties including manufacturers to ensure such requests are followed.
  3. PRICE AND PAYMENT
    1. The price you pay depends on the work that either we or a third party agree to carry out on your behalf.
    2. The standard cost of a refurbishment is £50 inclusive of VAT, unless advised differently.
    3. We will provide you with a quotation for our servicing work on receipt of your watch. The quotation provided to you, though given in good faith, is an estimation only based on the information you have provided.
    4. Where you wish to use our commission service, the details and estimated costs of any work required will be added to your online account for your approval. Where you authorise whether orally or in writing any work to be carried out on your watch, you will be charged the agreed price, regardless of whether or not the watch is subsequently sold. Estimates given by us are given in good faith, but are estimates only. Please see our “Sell Your Watch” document for full terms and conditions that apply.
    5. If you have a valid claim against our warranty, then we will carry out the work free of charge. Please see our “Warranty” document for full terms and conditions that apply.
    6. Where we instruct work to be carried out on your behalf by other parties, we will provide you with the quotation (if applicable) of the third party for your approval either orally or in writing.
    7. The price quoted to you is in Pounds Sterling unless advised differently. You will be responsible for the exchange rate and you are advised that any refunds may be affected by such exchange rate. Payments must be made in pounds sterling and any refunds will only be issued in Pounds Sterling.
    8. The price quoted includes VAT (or similar sales tax) at a rate of 20% (or other prevailing rate.) However, if the rate of VAT changes between the date of the quotation and the date of delivery or performance, we will adjust the rate of VAT that you pay for work to be carried out by us, unless you have already paid for the work in full before the change in the rate of VAT takes effect.
    9. The price for the work excludes delivery costs, which will be added to the total amount due.
    10. If we receive a watch for work that is quoted but not proceeded, then a return postage cost of £12.00 will apply if you are based in the UK (unless the decision not to proceed with the work is ours, in which case no return postage charge will apply.) If you are based outside of the UK, a courier will be selected at our discretion and postage and insurance costs will be payable by you.
    11. If we arrange for a third party to prepare a quotation for servicing or other work to be carried out on your watch on your instruction, but you do not proceed with the work in question, an administrative charge may be charged by the third party, which will be payable by you.
    12. All fees due to us must be paid by you before we can arrange to return your watch to you. Without prejudice to any of our other rights or remedies, we shall have a general and particular lien over all items in our possession which are the property of you to secure payment by you of all sums due from you to us under any contract whatsoever.
  4. DELIVERY
    1. You must send your watch to Watchfinder.co.uk Limited at Invicta House, Pudding Lane, Maidstone, Kent, ME14 1NX unless advised differently. Postage, packaging and insurance will be your responsibility and at your cost (we recommend you use a tracked mail system and retain proof of postage). Please ensure that you pack your watch appropriately to prevent damage during transit.
    2. If you are based within the UK, we will return your watch to you once the work is completed by Royal Mail's Special Delivery™, and the cost of postage will be at your cost (£12.00 unless advised differently). If you are based outside of the UK, a courier will be selected at our discretion and postage and insurance costs will be payable by you.
    3. Delivery of the watch will be completed when we deliver the items to the address you gave us or you collect them from us. Please note that if you arrange for your own courier to collect your watch, delivery will be completed when the watch is collected from our offices.
    4. Please see the clause 5 below in relation to our maximum liability. We recommend that you check your household insurance policy to ensure that your watch is covered whilst it is with us and whilst in transit back to you, or arrange an appropriate extension to your policy.
    5. Without prejudice to clauses 4(d) and 5, risk in the watch will pass to you on completion of delivery.
    6. If you are based outside of the UK, you may also have to pay import/export duty or other taxes, fees and charges applied by customs or other authorities for work carried out on your watch, particularly if you do not correctly complete the relevant declarations. You must comply with all laws and regulations of your country. Any additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. If you are unsure about whether these charges might apply to your order, you should contact your local tax or customs office for further information.
  5. OUR LIABILITY
    1. Nothing in these terms and conditions shall limit or exclude our liability for:
      1. death or personal injury caused by our negligence, or the negligence of our employees, agents or subcontractors (as applicable);
      2. fraud or fraudulent misrepresentation; or
      3. any matter in respect of which it would be unlawful for us to exclude or restrict liability.
    2. Subject to the clause 5(a), we shall under no circumstances whatever be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or any indirect or consequential loss arising under or in connection with work carried out on your watch by:
      1. us; or
      2. any third party including without limitation manufacturers; and
    3. Subject to the clauses 5(a) and 5(b), our total liability to you in respect of all other losses arising under or in connection with work carried out on your watch, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the sum of £1,000 or the market value of your watch as estimated by us (whichever is lower).
    4. Without prejudice to clauses 5(a), 5(b) and 5(c), we shall not be liable to you for any loss, injury, damage, expense or delay incurred or suffered by you arising directly or indirectly from or in any way connected with:
      1. a failure by you to reclaim your watch within 6 calendar months of the date of completion of the work being notified to you;
      2. any sentimental or other non-commercial value stated by you to attach to your watch;
      3. the mechanical workings of your watch either whilst in our possession or after work has been completed on your watch, unless you instruct us to carry out a full service of your watch which includes a complete overhaul of the movement;
      4. any refusal by a manufacturer or other parties to carry out work under warranty as a result of work carried out by or on behalf of us if your watch is still protected by its original manufacturer warranty and work that we or third parties carry out invalidate your warranty; or
      5. The instruction by us to a third party for work to be carried out on your watch on your behalf.
  6. WAIVER
    1. If we fail, at any time during the term of a contract, to insist upon strict performance of any of your obligations under the contract or any of these terms and, or if we fail to exercise any of the rights or remedies to which we are entitled under the contract, this will not constitute a waiver of such rights or remedies and will not relieve you from compliance with such obligations.
    2. A waiver by us of any default will not constitute a waiver of any subsequent default.
    3. No waiver by us of any of these terms and conditions will be effective unless it is expressly stated to be a waiver and is communicated to you in writing.
  7. SEVERABILITY
  8. If any court or competent authority decides that any of the provisions or paragraphs of these terms and conditions or any provisions of a contract are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.

  9. ENTIRE AGREEMENT
    1. These terms and conditions and all other documents referred to in these terms and conditions constitute the entire agreement between the parties and supersedes and extinguishes all previous drafts, agreements, arrangements and understandings between them, whether written or oral, relating to its subject matter.
    2. Each party agrees that it shall have no remedies in respect of any representation or warranty (whether made innocently or negligently) that is not set out in these terms and conditions. No party shall have any claim for innocent or negligent misrepresentation based upon any statement in these terms and conditions.
  10. THIRD PARTY RIGHTS
  11. This contract is between you and us. No one other than a party to this agreement shall have any right to enforce any of its terms. The Contracts (Rights of Third Parties) Act 1999 is expressly excluded.

  12. EVENTS OUTSIDE OF OUR CONTROL

We will not be responsible for any failure to perform, or delay in performance of, any of our obligations under these terms and conditions that is caused by events outside our reasonable control including without limitation Acts of God, fire, flood, severe weather, explosion, war, act of terrorism, industrial dispute (whether or not involving Watchfinder employees), or acts of local or central government or other competent authorities. This does not affect your statutory rights.

  14. NO PARTNERSHIP OR AGENCY

Except as expressly provided, nothing in these terms and conditions is intended to, or shall be deemed to, establish any partnership or joint venture between the parties, constitute either party the agent of the other, nor authorise a party to make or enter into any commitments for or on behalf of the other party.

  16. COMMUNICATIONS BETWEEN US
    1. When we refer, in these terms and conditions, to "in writing" or “written”, this will include e-mail.
    2. If you wish to contact us in writing, or if any clause in these terms and conditions requires you to give us notice in writing, you can send this to us by e-mail or by pre-paid post to Watchfinder.co.uk Limited at legal@watchfinder.co.uk or Invicta House, Pudding Lane, Maidstone, Kent, ME14 1NX. We will confirm receipt of this by contacting you in writing, normally by e-mail.
    3. If we have to contact you or give you notice in writing, we will do so by e-mail or by pre-paid post to the address you provide to us in your order.
  17. OUR RIGHT TO VARY THESE TERMS AND CONDITIONS
    1. We have the right to revise and amend these terms and conditions from time to time.
    2. You will be subject to the policies and terms and conditions in force at the time that you order items from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we agree to carry out work on your watch (in which case we have the right to assume that you have accepted the change to the terms and conditions).
    3. No other variation of these terms and conditions shall be effective unless it is in writing signed by the parties (or their authorised representatives).
  18. GOVERNING LAW AND JURISDICTION
    1. These terms and conditions and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
    2. The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this agreement or its subject matter or formation (including non-contractual disputes or claims).

Promotions

All promotional offers and/or discount vouchers and/or free gifts (the “Promotions”) are subject to the following terms and conditions:

  1. Promotions are open to residents of the UK, Channel Islands, Isle of Man and Republic of Ireland aged 18 years or over as at the start date of the relevant promotion, except employees of Watchfinder.co.uk Limited, anyone else professionally associated with the offer or any member of their households.
  2. Maximum 1 offer or voucher per customer and per transaction. Only one entry per person will be accepted for all prize draws and multiple entries using the same information will be treated as one entry.
  3. Vouchers/offers can only be redeemed against single items of a value of £1000.00 or greater (unless advised differently) and transactions must be of an equal or higher value than the voucher.
  4. Promotions are as stated, are non-transferable, no cash alternative will be offered and no change will be given.
  5. Vouchers are and shall remain our property and are not for resale or publication.

WEEE Regulations

As a responsible retailer, we comply with the Waste Electrical and Electronic Equipment Regulations 2006 (the Regulations).

Any product that requires electricity or batteries to enable it to perform its primary function is classed as electrical or electronic equipment (EEE), such as a battery-powered watch. We are committed to reducing the environmental impact of providing high quality products by recycling our products when they become waste electrical and electronic equipment (WEEE).

It is important that the amount of WEEE sent to landfill sites is reduced. Some WEEE can be re-used or recycled. The amount of landfill space available in the UK is decreasing. If we can keep WEEE out of landfill sites it means there is more landfill space available for non-recyclable waste. Further, WEEE can also contain hazardous substances. When left in landfill sites, these hazardous substances can pollute soil and contaminate water supplies. This contamination can damage human health and the environment.

Distributors of new EEE have a part to play in reducing the amount of WEEE going into landfill sites.

We are doing our bit under the Regulations by offering our customers a free of charge "take-back" service of your WEEE on a like-for-like basis when you buy a new EEE product from us.

For example, if you buy a new battery-powered watch from us we will take back your old battery-powered watch and prevent it going into a landfill site by disposing of it safely. You must return your old WEEE within 28 days of purchasing your new item. You do not have to pay to return your old item to us.

Under the Regulations, all new electrical goods should now be marked with the crossed-out wheeled bin symbol. Goods are marked with this symbol to show that they were produced after 13 August 2005, and should be disposed of separately from normal household waste.
